SALES CLUB – TERMS AND CONDITIONS

These terms and conditions ("Terms") apply to your membership in Sales Club, a 12-week group programme operated by Your Best Next Move ("Paul", "we", "us", "our").

1. PAYMENT AND COMMITMENT

Payment and Fees

Sales Club is priced at £600 + VAT for a full 12-week programme (£50 + VAT per week). Members may pay in full upfront or in three instalments of £200 (payable at weeks 1, 5, and 9). Payment is non-refundable once the programme has commenced. Cancellations made before your first session date will receive a full refund.

Programme Duration

Each programme runs for 12 weeks from your first session attended. Membership is a commitment to the full 12-week block. Partial withdrawals do not reduce the fee owed. Re-enrolment in future cohorts is optional but members who joined at introductory pricing will retain that rate for as long as Sales Club runs.

Payment Method

Payment is processed via Stripe and connected to Your Best Next Move's accounting system. A receipt will be issued automatically upon successful payment.

2. ATTENDANCE AND MISSED SESSIONS

Session Access

Your membership gives you access to the Sales Club programme, not to individual sessions. There are no refunds, credits, or make-up sessions for missed group sessions or one-to-one sessions.

Absence

If you miss a group session, the programme continues and you will be brought up to speed by fellow members and Paul. The programme is designed to accommodate occasional absences without derailing your progress. However, consistent attendance maximises your benefit.

Paul's Cancellations

If Your Best Next Move Limited cancels a session, it will be rescheduled within the same 12-week block at a mutually agreed time.

3. CONFIDENTIALITY

What's Shared Stays Shared

Sales Club operates on a confidentiality basis. Everything discussed in group sessions, one-to-one sessions, and the WhatsApp community is confidential. Members agree not to share details of other members' businesses, challenges, or strategies outside the group without explicit permission.

Permission to Share

Members may share their own learnings and insights freely. Members may not identify other members or their businesses when sharing their own experience publicly.

Your Best Next Move Limited's use of Insights

Your Best Next Move Limited may reference general themes, frameworks, and anonymised case studies from the group in future marketing, teaching, or content creation without revealing member identities.

4. INTELLECTUAL PROPERTY

Your Best Next Move Limited's Materials

All frameworks, templates, processes, and materials developed or provided by Paul remain his intellectual property. Members receive a licence to use these materials for their own business purposes only. Members may not sell, distribute, republish, or claim ownership of any materials provided as part of Sales Club.

Member Work

Any work, strategies, or insights developed by members during Sales Club belong to those members. Members grant Paul permission to use anonymised versions of member work as examples or case studies.

5. CODE OF CONDUCT

Respectful Participation

Members commit to treating all other members and Paul with respect. Behaviour that is abusive, discriminatory, or harmful to others is not tolerated and may result in removal.

No Pitching or Selling

Sales Club is a peer-support and learning environment, not a networking event for client acquisition. Members agree not to pitch their services to other members or use the group for direct sales. Building genuine relationships and occasional referrals that arise naturally are welcome; organised pitching or sales activity is not.

Engagement

Members are expected to engage authentically in discussions, share honestly about challenges, and actively participate in sessions. Passive attendance without engagement may result in Paul raising concerns about fit.

6. DATA PROTECTION AND GDPR COMPLIANCE

Data We Collect

We collect your name, business details, contact information, and responses to the intake questionnaire. This data is stored in HubSpot (Your Best Next Move's CRM) and is used solely for programme administration, personalisation of your 1:1 sessions, and follow-up communication.

Data Use

Your data will not be sold, shared with third parties, or used for marketing purposes without your explicit consent. We may use anonymised data to improve the programme.

Data Retention

Your data is retained for the duration of your membership and for 12 months after the programme ends, unless you request deletion. You have the right to request access to your data, correction, or deletion at any time by emailing paul@yourbestnextmove.com.

WhatsApp Community

The WhatsApp group is a private community. Ensure your privacy settings are appropriate and that you understand WhatsApp's own data policy. Paul will not share WhatsApp data with third parties.

7. LIMITATION OF LIABILITY

No Guarantees

Sales Club provides guidance, frameworks, and accountability. Results depend on your effort, market conditions, and business circumstances. Paul makes no guarantee of specific business outcomes, revenue targets, or client acquisition.

Professional Service

Sales Club is educational and advisory support, not legal, financial, or tax advice. Members should consult appropriate professionals (accountants, lawyers, etc.) for specific legal or financial guidance.

Liability Cap

Your Best Next Move Limited's liability for any claim arising from Sales Club is limited to the fees paid by the member for the affected programme.

8. TERMINATION BY YOUR BEST NEXT MOVE

Right to Remove Members

Your Best Next Move Limited reserves the right to remove any member who: breaches the Code of Conduct; repeatedly disrespects confidentiality; engages in abusive or harmful behaviour; or demonstrates fundamentally different values or approach that compromises the group dynamic.

Removal Process

In cases of serious breaches, removal may be immediate. In cases of ongoing concerns, Paul will first raise the issue with the member privately to understand and potentially resolve the situation. If removal occurs after the programme has commenced, no refund is issued.

Natural Conclusion

If the group size drops below 6 members due to cancellations or withdrawals, Paul reserves the right to offer remaining members the choice to continue with a smaller group at the same fee, receive a pro-rata refund for remaining sessions, or join the next cohort free of charge.

9. GENERAL TERMS

Modifications

Your Best Next Move Limited reserves the right to modify these Terms with 30 days' notice. Continued membership after the notice period constitutes acceptance of updated terms. Changes to core elements (fees, duration, content) will be communicated clearly.

Severability

If any part of these Terms is found to be invalid or unenforceable, the remaining parts remain in full effect.

Governing Law

These Terms are governed by English law and the courts of England and Wales have jurisdiction.
